1. Interpretation & Definitions

Interpretation
Capitalized words used in these Terms have defined meanings as outlined below. These terms apply regardless of singular or plural usage.

Definitions

  • Affiliate: An entity controlling, controlled by, or under common control with Prakino. 
  • Company / We / Us: Prakino, (Plot no. 444, Sumer Nagar, Behind Ram Mandir,
          Mansarovar, Rajasthan, 302020,
          Jaipur, Rajasthan-302020, India). 
  • Device: Any device used to access our Service (e.g. computer, phone, tablet).
  • Goods: Makhana snacks and related food products sold on the Service.
  • Orders: Requests placed to purchase Goods via the Service
  • Promotions: Incentives like contests or special offers on the Service.
  • Service / Website: Prakino’s online platform at prakino.com.
  • You: The individual or entity accessing or making purchases.

 

2. Acknowledgment
By accessing or shopping on Prakino, you confirm that you are 18+ years old, legally capable, and agree to abide by these Terms and our Privacy Policy. If you disagree, please stop using the Service.

3. Placing Orders & Your Information

  • You must provide accurate personal and payment information when ordering.
  • You ensure you have legal rights to use provided payment methods.
  • You agree to share details with payment processors for transaction completion. 

4. Order Cancellation
We may cancel or refuse any Order for reasons such as:

  • Product unavailability
  • Pricing or description errors
  • Fraud or unauthorized activity

If we cancel a paid Order, we'll refund you within 14 days to the original payment method.  

5. Your Order Cancellation Rights
You may cancel an Order within 24 hours of placement without needing to state a reason. To cancel, contact us via email or through your account portal. Refunds are issued within 14 days after we receive your cancellation confirmation. 

6. Returns & Refunds
Returns and refunds are guided by our Return & Refund Policy, incorporated here:

You may return Goods only if:

  • Delivered item is incorrect, damaged, defective, or expired
  • You inform us within 24 hours of delivery, including Order ID and photo proof
  • We approve the return after verification

Non-returnable items include:

  • Personalized Goods
  • Perishable items past expiry or unsealed due to hygiene
  • Opened items, taste preference changes, or post-24-hour issues

7. Return Shipping

  • Return shipping cost and risk is your responsibility unless approved by us.
  • Use trackable, insured shipping when sending back Goods.
  • Ship to our returns address (will be updated on-site).
  • We inspect returns before processing refunds or replacements.

8. Refund Processing

  • Upon receipt and inspection, refunds are processed within 14 days via the original payment method.
  • Refund amounts are non-deductible.

9. Availability, Errors & Price Policy

  • Product listings may contain mistakes (price, description, availability).
  • We may correct errors and cancel or adjust Orders if needed. You have the right to cancel in such cases. 

10. Payment Methods
We accept payments via major credit/debit cards, UPI, net banking, wallets. Payment authorization is subject to third-party provider approval; delays or failures are not our liability.

11. Promotions
Promotional offers are subject to specific terms, in addition to these Terms and Conditions. 

12. Intellectual Property
All Service content—text, images, logos—is Prakino’s property or our licensors’. Usage is prohibited without written consent. 

13. Links to Other Websites
Our Service may link external content we don’t control. We aren’t responsible for their practices or consequences. 

14. Termination
We may suspend or terminate your access without notice if you breach these Terms. Upon termination, your rights to use the Service end immediately. 

15. Limitation of Liability
To the fullest extent permitted by law:

  • Our liability is capped at the amount you paid for the products.
  • We aren’t liable for indirect, incidental, or punitive damages.

16. “AS IS” Disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, including merchantability or fitness for purpose. 

17. Governing Law & Dispute Resolution
These Terms are governed by the laws of India (Rajasthan). Disputes should first be resolved informally; unresolved issues can be brought before courts in Jaipur. 

18. Severability & Waiver
If part of these Terms is unenforceable, the rest remains valid. Failure to enforce a right doesn't waive future enforcement. 

19. Changes to Terms
We reserve the right to modify these Terms at any time. Material updates will be announced 30 days in advance. Continued use means acceptance.
